West Morgan-East Lawrence Water and Sewer Authority, 3M Company, Dyneon, L.L.C., and Daikin America, Inc. are named in a Class Action Complaint brought by residents of Lawrence County in connection with allegedly tainted water.
According to the complaint, all of the plaintiffs, 23 in total, are or have been customers of West Morgan-East Lawrence Water and Sewer Authority and allege they “have sustained injuries and risk further immediate and irreparable harm” and that the defendants “knew that their actions contaminated the water of the Tennessee River and that it was used for public consumption, yet failed to warn Plaintiffs of the presence of these chemicals until Plaintiffs sustained irreparable injuries.”
The chemicals referred to are PFOA, PFOS, and related chemicals that were at the center of a controversy over water provided by the West Morgan-East Lawrence Water and Sewer Authority to its customers.
In 2016, customers of the West Morgan-East Lawrence Water Authority were warned, for a time, not to drink the water. This led to confusion and disruption in among customers, along with questions about chemically tainted water, who knew what and when they knew it.
Daikin agreed to pay the West Morgan-East Lawrence Water and Sewer Authority in a previous settlement.
According to the Water Authority, a new filtration system went online in September of 2016.
