DECATUR, Ala. — Three of the four Decatur police officers names in the wrongful death lawsuit filed by Catrela Perkins in the wake of the death of her husband Steve Perkins have asked to be dismissed from the lawsuit.
In a motion filed on February 29, attorneys for Christopher Mukadam, Joey Williams, and Vance Summers argued that the "Plaintiff [Catrela Perkins] has failed to allege facts supporting a plausible claim for failure to intervene for wrongful death. In the alternative, Defendants are immune from suit."
The motion goes on to argue that the three men "were not in a position to stop Officer Marquette from shooting Perkins," and that if Perkins “'had no time to respond to [Marquette’s] verbal commands'" before Marquette fired multiple gunshots, ultimately killing Perkins...then neither did the officers."
Later, the motion claims that the three men are entitled to Qualified Immunity because "the non-shooting officers' actions here were taken pursuant to their law enforcement authority and in the performance of those duties."
The fourth officer involved in the incident, Mac Bailey Marquette, has been indicted on a charge of murder. His trial is expected to begin in November 2024.
